1. What this covers
This policy is for rights holders reporting product photographs, descriptions, logos, brand names, designs or other material published on a store built on Shopdrop without permission.
This is not a route for order problems. If you bought something and it has not arrived, or it is not what was described, contact the store you bought from. See our contact page.
2. Reporting an infringement
Email info@shopdrop.pro with the subject line "Copyright notice". We cannot act on an incomplete report, so please include all of the following:
- Your name, postal address, email address and telephone number.
- Identification of the work. What you own, with a link to where it appears legitimately if there is one.
- The exact location of the infringing material, as a full URL. A store's home page is not enough; we need the page carrying the material.
- A statement that you believe in good faith that the use is not authorised by you, your agent or the law.
- A statement that the information in your notice is accurate, and that under penalty of perjury you are the rights holder or authorised to act for them.
- Your physical or electronic signature.
These are the elements required by the United States Digital Millennium Copyright Act. We apply the same standard to notices from anywhere, because it is a fair test of whether a complaint is serious.
3. What happens next
- We acknowledge your notice within two business days.
- Where the notice is complete and the claim is credible, we remove or disable access to the material, usually within five business days.
- We tell the merchant what was removed, why, and who complained, and we forward them your notice. Your contact details are part of that, so send it from an address you are willing to share.
- We tell you what we did.
We are not a court. We are not able to decide who owns a disputed design, and we will not try. Where a claim is genuinely contested, both sides may need to resolve it elsewhere, and we will act on an order once one exists.
4. If your content was removed
If you are a merchant and we removed something you had the right to publish, reply to the notice we sent you with a counter-notice containing:
- Your name, address, email and telephone number.
- Identification of what was removed and where it appeared.
- A statement, under penalty of perjury, that you believe in good faith it was removed as a result of a mistake or misidentification.
- Your consent to the jurisdiction of the courts where you live, and your agreement to accept service from the complainant.
- Your signature.
We forward valid counter-notices to the complainant. If they do not begin legal proceedings within 14 business days, we may restore the material.
5. Repeat infringers
A store that receives three upheld complaints within any twelve month period is closed, and its owner may not open another account. We count a complaint as upheld when we removed material and no valid counter-notice followed.
We may act sooner where a store is plainly built on someone else's brand, for example one selling counterfeits or copying a brand's site wholesale. That is a breach of section 5 of our Terms of Service and does not need three notices.
6. Trademark complaints
Send trademark complaints to the same address, with your registration number, the jurisdiction and classes it covers, and the URLs where the mark is being misused. Explain briefly why the use is likely to confuse customers, since using a word that happens to be a trademark is not by itself infringement.
7. Bad-faith notices
Deliberately misrepresenting that material infringes carries legal liability to the person whose content you had removed. We keep every notice on record. If we conclude someone is using this process to attack a competitor rather than to protect a right, we will refuse further notices from them and tell the affected merchant.
